Toward the end of 2005, David G. Pribyl and Patrick A. Salvi reached a substantial settlement of $4 million in a cerebral palsy suit. The case, which was settled in Alamance County, North Carolina, is among the largest cerebral palsy settlements in the county’s history, and a significant amount in North Carolina relative to the state’s case history.
In late 1999, the expectant mother was admitted to the hospital as an obstetrical patient. David Pribyl alleged that the respective doctors waited too long to perform a cesarean delivery - even though clear signs of a dysfunctional labor and fetal distress were present. As a result, the infant did not receive an adequate amount of oxygen. At just over 12 hours of age, the newborn began having seizures. Shortly afterwards, the child went into cardiac arrest and had to be resuscitated.
“This baby was born with neurological deficits and will need medical care for the rest of his life,” said Patrick Salvi. “Medical neglect can happen to anyone, anywhere, and at any time; but it’s especially troubling when young children are involved.”
