Principal Attorney Michael P. Schostok of the law firm Salvi, Schostok & Pritchard P.C. announced today that a $4 million settlement was reached on behalf of a child injured at birth at Rockford Memorial Hospital.
On November 2, 1998, Treva Brown, 23 of Rockford, Illinois, was admitted to Rockford Memorial Hospital as an obstetric patient. Due to Ms. Brown’s previous births, medical records indicated that she was a high-risk pregnancy. Previously, she was admitted twice for premature labor. Attorneys for the plaintiff alleged that the mother's doctor failed to deliver her son in a timely manner after there were clear signs of fetal distress. As a result, Jamarius Cavitt was unable to receive a proper level of oxygen and was born permanently brain damaged. This tragedy could have been avoided if the doctor would have followed the standard of care.
The combined settlement of $4,000,000 was paid to the minor, Jamarius Cavitt, by St. Paul Insurance. The Honorable Judge Holmgren of the Circuit Court of the Seventeenth Judicial Circuit, Winnebago County, Illinois, approved the settlement.
