Principal attorney Patrick A. Salvi of the law firm Salvi, Schostok & Prithchard P.C. obtained a $1.5 million medical malpractice/wrongful death settlement on June 24, 2003. The lawsuit was filed on behalf of the parents of an infant who died after several errors occurred during the delivery.
On May 4, 2000, Diane Vickery, 31 of Yorkville, Illinois, was admitted to Morris Hospital in Morris, Illinois, for induction of labor and delivery of her unborn child. Attorneys for the Plaintiff alleged that the mother’s Obstetrician waited too long to perform a c-section after there were clear signs of a dysfunctional labor pattern and fetal distress. Instead of calling for a timely c-section, the Co-Defendant, on numerous occasions, attempted to deliver the infant by using a vacuum extractor. As a result, Andrew Vickery was born in a depressed state with bleeding in the brain on May 5, 2000. The infant was transferred to Loyola Hospital in Chicago where he later died on May 16, 2000.
"There was an unnecessary delay in attempting to deliver this child. A simple c-section would have given him the oxygen he needed and saved him from the head trauma he received," said Patrick Salvi. "If medical staff would have responded to this mother and her child in a timely manner, Andrew would be a healthy 3 year-old boy today."
The settlement was approved in the Circuit Court of Grundy County, Illinois by the Honorable Judge Lance R. Peterson. For additional information on the Vickery case, Patrick A.
