Family to File Wrongful Death Lawsuit Today Against Go Bananas LLC

CHICAGO, IL – The family of a 3-year-old Dolton boy killed after falling out of a roller coaster ride for kids at Go Bananas, a popular family entertainment center located in Norridge, Illinois is preparing to file a wrongful death lawsuit today.

In the early evening of April 2, 2011, Jayson Dansby, deceased, and his twin brother were riding in the front car of a children's roller coaster during a family visit to Go Bananas, when Jayson fell out of the car he was riding in and was fatally struck.

"The statements that have since been made by the defendant, its owner and lawyer that there was no mechanical or human error is plain wrong," said Patrick A. Salvi, the Dansby's family attorney.  "The police report, operator statement and our investigation to date show this ride was not safe—and it could not be stopped [emergency brake failed and/or was defectively designed/maintained] when it was very clear this little boy was in extreme danger. And, interestingly enough, the maintenance records on the ride mysteriously disappeared when requested by the police."  

Patrick A. Salvi will be holding a press conference today, Wednesday April 20th, at 12:00 PM in our Chicago office (22 W. Washington, Suite 1600) to discuss the lawsuit.  Hard-copy pictures of Jayson Dansby will be available. In addition, initial investigation evidence samples will be on display and copies of the complaint handed out to those in attendance.

"This was gross negligence," continued Patrick Salvi.  "To make matters worse, this child died on a children's amusement park ride… in front of his parents and twin brother. No one should ever have to experience this kind of preventable tragedy."
