Protecting Residents from other Residents

Plaintiff Raped in Chicago Nursing Home

CHICAGO,IL–A nursing home lawsuit was filed late this afternoon in Cook County by the law firm of Salvi Schostok & Pritchard P.C., on behalf of Margaret Scott, deceased, a nursing home resident in Chicago who was raped by another resident on April 13, 2004.

Margaret Scott, 74-years-old at the time of the incident, had been diagnosed with Alzheimer’s disease and Dementia. Mrs. Scott, a resident in the geriatric wing at Columbus Park Nursing Home and Rehab Center, was physically and sexually abused by another resident who resided on the same floor. On the evening of the incident the alleged offender, who had been diagnosed with Schizophrenia, was observed exiting Mrs. Scott’s room. Unfortunately, there was no attempt by the facility to segregate the two patients.

“It’s the Nursing Homes’ responsibility to protect its residents. This simply did not happen,” said lead Plaintiffs’ attorney David G. Pribyl of law firm of Salvi Schostok & Pritchard P.C. “Mrs. Scott and her family had every right to trust that Columbus Parkwould take whatever steps were necessary to keep her from harm. Their failure to protect her is unacceptable and was the direct cause for this tragic incident.”

The complaint was filed in the circuit court of Cook County on Wednesday, April 9th 2008. Edgar Scott, as Independent Administrator of the Estate of Margaret Scott deceased, Plaintiff, vs. COLUMBUS PARK, LLC, d/b/a COLUMBUS PARKNURSING&REHABILITATIONCENTER, INC., an Illinois Corporation; and Individually, BEVERLY MILES, R.N.
