$3.25 Million Medical Malpractice Settlement

Salvi, Schostok & Pritchard P.C., attorney announced a $3.25 million medical malpractice settlement on behalf of the estate of a mother and her newborn child who were injured and died as a result of the Defendants’ alleged failure to properly manage the labor and delivery. The Honorable Kathy M. Flanaghan, Law Division, Circuit Court of Cook County (Illinois), approved the settlement.

On September 27, 2004, 29-year old Tosha Lunford-Mondesir of Maywood, Illinois, was admitted to South Suburban Hospital in Hazel Crest, Illinois, for the delivery of her daughter, Chloe. During the early morning hours of September 28, her fetal heart rate monitor and vitals began to demonstrate significant fetal distress. Non-operative interventional measures were initiated without any improvement. The available information demonstrated that the fetus needed to be delivered immediately and emergently. The attending OB was paged twice and once he arrived at the hospital, he attempted to deliver Chloe vaginally by using two different types of mechanical delivery procedures; a vacuum extraction and forceps. During this process, Tosha began to bleed and died shortly thereafter. An autopsy performed on Tosha concluded that she died from an amniotic fluid embolism (AFE). Chloe, who should have been delivered via c-section, was delivered in a very depressed state due to the delayed delivery. She lived for several days before succumbing to her injuries.
