Pedestrian Accident Settlement 

Jennifer L. Ashley obtained a settlement on behalf of a five-year-old boy who was struck by a U.S. Postal Service truck as he crossed the street outside of his home. The truck dragged the child approximately 10 feet. As a result of this pedestrian accident, the child suffered a concussion, fractured clavicle and lacerations to his ear and face, and he needed to undergo plastic surgical reconstruction of his scalp and ear.

Jennifer L. Ashley settled this pedestrian accident case for a 22-year-old woman who was hit by a vehicle when crossing the street to go to work. The driver was ticketed and pled guilty to failing to yield. The plaintiff suffered abrasions on her hands, left knee, right foot and left elbow as well as a contusion to her right leg.

Jeffrey J. Kroll and Jennifer L. Ashley obtained this settlement on behalf of an elderly couple that was struck by a vehicle outside of a Wal-Mart. Both suffered head injuries in the pedestrian accident.

The couple had been walking next to each other in a crosswalk leading from the Wal-Mart parking lot. The driver of a full-sized pickup truck admitted that he did not see the couple. Despite a “pedestrian crossing sign,” he hit them with his truck.

The woman suffered a closed-head injury, with bleeding on the brain. The man suffered a closed-head injury as well and a large hematoma to his hip. Both were transferred from the hospital to a nursing home for therapy.

Medical Malpractice Settlement

David J. Pritchard and Aaron D. Boeder were able to obtain this medical malpractice settlement for a client who failed to have his kidney cancer timely diagnosed. The client’s urologist interpreted a kidney ultrasound, documented a possible tumor and noted the need to follow-up, but failed to do so. It was not until more than a year later, the client found out he was suffering from stage IV renal carcinoma and the cancer had spread to his lungs, liver, and groin. The delay in diagnosis significantly diminished the client’s chances of treatment and survival.

Slip-and-Fall Accident Settlement 

Jennifer L. Ashley obtained a settlement for a client who was injured in a slip-and-fall accident at Pete’s Fresh Market. Our client alleged that she had slipped on a creamy substance on the floor near the bakery / deli section of the store. A nearby store employee unsuccessfully tried to catch our client as she fell.  As a result of the fall, the client fractured her ankle and needed to undergo surgery.

Rear-End Car Accident Settlement 

Jennifer L. Ashley obtained this settlement for a client who had been injured in a rear-end auto accident while dropping off her son at elementary school. The school’s principal witnessed the accident. Due to the impact, the client suffered a left shoulder injury that required steroid injections and physical therapy.

Pedestrian Accident Settlement 

Jennifer L. Ashley secured a settlement in this matter on behalf of a client who was struck by a driver and suffered a head injury in a pedestrian accident. Our client was crossing the street in a crosswalk in Lake County when an elderly driver struck him with his vehicle and left the scene of the accident. A witness took a photo of the driver’s license plate with her cell phone, which helped police to locate the driver. The 84-year-old man was disoriented and confused, but he admitted that he had struck our client. As a result of the accident, our client suffered a subdural hematoma that required an emergency craniotomy, replacing his skull with a plate and screws. Also, he suffered a fracture and MCL tear in his left knee. The insurance policy limits were tendered by the driver’s insurance company. Our firm is now pursuing the underinsured motorist (UIM) policy limits.

Side-Impact Collision Settlement 

Sarah A. Ferrill recently settled this auto accident case for our client, who had a degenerative disc disease that was exacerbated by the incident. The side-impact collision, or “T-bone collision,” occurred when the defendant ran a red light and struck our client.

Car Accident Settlement 

Jennifer L. Ashley settled this matter for a client who needed to have an emergency C-section due to a possible placental abruption that she sustained in an auto accident.

Our client, a 33-year-old woman, had been the passenger in a vehicle driven by her husband. They were driving with a green light when another driver made an abrupt left turn in front of them. The client was pregnant with her first child and one day past her due date.

As a result of the accident, our client was placed on monitoring at the hospital. The monitoring detected fetal decelerations indicative of early placental abruption. The hospital, in turn, performed the emergency C-section. The C-section was the opposite of the natural birth plan that the client had envisioned. Fortunately, a healthy baby girl was born, and both mother and baby were fine.

Bicycle Accident Settlement 

Jennifer L. Ashley settled this for a client who was injured in a bicycle accident. The client, a 42-year-old avid bicyclist, had been biking on a Lake Forest bike path in the afternoon on an unseasonably warm day in March 2012. As he rode his bike on the path, his pedal caught a dark metal anchor that was attached to a guide wire supporting a Com Ed utility pole. The metal anchor abutted the bike path and could not be seen by our client. As a result, the client struck his forehead on the pavement and suffered a laceration that required stitches and left a small scar.

Jennifer L. Ashley secured a settlement for a client who sustained a head laceration as a passenger in a car accident. The client, a 54-year-old woman, had been traveling in a van with six co-workers from a real estate office going on an office tour.  Another vehicle rear-ended the van, causing our client to strike the right side of her head on the passenger window.  She suffered the laceration to her forehead. The injury required six stitches and left a scar.

Colin M. Jones obtained this settlement on behalf of our client, a young man who sustained injury due to a dog bite. The dog’s owner had no insurance. An out-of-pocket settlement was negotiated.

Jennifer L. Ashley secured a settlement in a dog bite case in which a five-year-old boy was bitten on the foot by a St. Bernard while at daycare.  He had five stitches at the wound site and developed a MRSA infection.  The defense contended that the boy provoked the dog to bite him.

Colin M. Jones obtained a settlement in this car accident case on behalf of a client who aggravated a pre-existing condition in the collision, which resulted in a back strain. The client’s pain was resolved with physical therapy. She did not require future medical care.

Jennifer L. Ashley settled this case on behalf of an 85-year-old woman who suffered minor injuries in a car accident. The woman had been driving to church when a driver who ran a red light due to “sun in his eyes” struck her vehicle. The collision pushed our client into a light pole. She stayed in the hospital for three days due to suspected brain injury, which was ruled out. The client then underwent six weeks of physical therapy for her soft tissue injuries.

Colin M. Jones secured a settlement in this auto accident case. Our client had been T-boned at an intersection. As a result, the client suffered a herniated disk and compiled several thousands of dollars in medical bills. The parties resolved the case before the filing of a lawsuit.

Four days after the crash, the client went to the emergency room complaining of neck and back pain. An MRI showed a disk bulge in her neck. She received chiropractic care. Her pain resolved after four months.

Colin M. Jones settled the under-insured portion of this pedestrian accident case. Our client had been struck by an auto while in a crosswalk. The client fractured his ankle, requiring no surgery. He also suffered a partial knee tear, which did require surgery.

Medical Malpractice Settlement

David J. Pritchard and Aaron D. Boeder settled this medical malpractice matter on behalf of the estate of a 53-year-old woman who died within hours after she was discharged from the hospital. The woman had respiratory problems. She went to the hospital because she was having trouble breathing. The hospital admitted her for three days before making the decision to discharge her home. The medical staff failed to check her oxygen levels before her discharge. The levels turned out to be quite low.  About an hour after she arrived home, the woman went into cardiac arrest and died because due to a lack of oxygen.

Sexual Assault Settlement

Jennifer L. Ashley obtained a settlement for a client who had been living with a family in France through an exchange program. She was sexually assaulted by one of the family members. The case was made more challenging because she was intoxicated at the time and didn’t immediately report the assault to authorities.

Dog Bite Settlement

Jennifer L. Ashley secured the settlement in this dog bite case. Our client and her German Shepherd puppy were attacked by a Pit Bull and a Boxer, who had a history of biting others in the past.  The client was bitten on her left hand, causing abrasions and a puncture wound.  She went to the ER and had a follow up with a hand specialist.  Her medical bills were $1,451.50.

Medical Malpractice Settlement

David J. Pritchard and Aaron D. Boeder were able to obtain this medical malpractice settlement for a client who suffered leg injuries after a doctor performed a laser treatment on the client’s vericose veins. During the course of the procedure, the doctor left portions of the materials used in the procedure in our client’s vein.  It was discovered years later. To remove the materials, the client required surgery.

Colin M. Jones settled this matter for a client who suffered soft-tissue injuries – but not permanent injuries – after being involved in a rear-end car accident.

Birth Injury Settlement

David J. Pritchard and Aaron D. Boeder achieved a settlement in this Peoria County birth injury case involving a girl who suffered a 3-inch scar on the top of her head. A family practice doctor used a vacuum extraction device to assist during the child’s delivery. The device was used improperly, which caused significant lacerations and disfigurement of our client’s scalp.  Multiple surgeries did not entirely remove the scar but did greatly improve its appearance.

Sarah A. Ferrill and Jennifer L. Ashley settled this pedestrian accident case involving a girl who was struck by a car while walking to school. She suffered a fractured tibia, but she had no permanent injury. The 14-year-old girl was crossing the street to go to high school on the first day of school. An SUV hit her and ran over her leg as she was in the crosswalk. She suffered a fractured right leg and scarring to her right ankle and leg.

Colin M. Jones secured this case on behalf of a client who sustained a minor fracture but no permanent injuries in an auto accident. Following the collision, the client required mobilization in a C-collar. The client did not require surgery or future medical care, and he has achieved a full recovery.

Premises Liability Settlement

Patrick A. Salvi II secured this settlement in a premises liability case involving a 4-year-old girl who was injured while shopping at a Wal-Mart store. An apparatus hanging on a shelf fell and lacerated the child’s face. The injury required stitches and left her with a 1- to 2-inch scar that would likely benefit from surgical repair.

Nursing Home Negligence Settlement

Patrick A. Salvi II settled this nursing home neglect case involving a 93-year-old female nursing home resident. Due to the nursing home’s neglect, the woman suffered dehydration and changes in her mental status. She was sent to the hospital, where she was left in the emergency room for 14 hours before being sent to the medical floor. While in the ER, no hospital staff member turned or repositioned her. She developed a Stage 4 pressure sore, which never heals. Our firm discovered further evidence that the nursing home failed to turn and reposition her after development of this very large pressure sore. The woman died about four months after the pressure sore developed.

Colin M. Jones settled this case involving a motor vehicle passenger who sustained a soft-tissue injury (cervical strain) in a rear-end vehicle collision. Fortunately, the passenger suffered no herniations, bulges or fractures, and all diagnostic testing (MRI, CT scans) came back negative. There also were no permanent injuries, lost wages or future medical treatment required.

Sarah A. Ferrill secured a settlement in this auto accident case on behalf of a driver who suffered bilateral hearing loss as the result of an airbag deployment at the time of impact. The defendant did not dispute liability. However, causation and the nature and extent of the damages were heavily disputed. The defendant claimed that our client suffered from degenerative hearing loss that was not caused by the accident.

Nursing Home Negligence Settlement

Matthew L. Williams settled this nursing home negligence case on behalf of a nursing home resident who had been over-medicated. The nursing home had failed to implement adequate fall precaution procedures. As a result, the resident suffered a fall and injured her leg.

Matthew L. Williams obtained a settlement in this case involving a victim who sustained a hip fracture in an automobile accident.

Jennifer L. Ashley settled this car accident case on behalf of a 26-year-old wheelchair-bound man who had been a passenger in a minivan driven by his wife. A DeKalb County Animal Control van ran a stop sign and T-boned the minivan. The hospital emergency room diagnosed the man with a suggested right knee fracture and probable left knee fracture.  DeKalb County agreed to settle the claim.

Aaron D. Boeder secured a settlement in this case involving a minor motor vehicle accident that occurred at a Chicago White Sox baseball game on opening day in 2011. A fan leaving at the game’s conclusion rear-ended our client’s car as he drove to work. The client suffered a hand injury in the collision. Thanks to medical treatment and physical therapy, he reached a near full recovery within six months after the crash.

Slip-and-Fall Accident Settlement

Colin M. Jones settled this slip-and-fall accident case in which our client suffered a severe fall while walking his dog. The client tripped on a three-inch high exposed metal sheet on a neighbor’s driveway. The fall caused him to sustain a fracture to the humerus that did not require surgical treatment.

The driver who caused the rear-end collision pled guilty to driving under the influence (DUI). Our client went to the emergency room the morning after the accident. She followed up with a family doctor and physical therapy for the next one-and-a-half months. Her medical bills totaled approximately $5,000.
