$1.25 million total recovery for 76-year-old woman struck in crosswalk

CHICAGO (October 1, 2026) — A 76-year-old woman who suffered a fractured femur after being struck by a vehicle has received a $1.25 million recovery, combining a liability settlement and underinsured motorist (UIM) coverage. The settlement was secured by Salvi, Schostok & Pritchard, P.C. Partner Jennifer L. Ashley representing Dorothy Malinski.

On October 3, 2023, Ms. Malinski was walking within the marked crosswalk at or near 7901 N. Milwaukee Ave. in Niles, Ill. when she was struck by a driver of a van who was making a left-hand turn on a solid green light.

As a result of the collision, Ms. Malinski sustained a right femur fracture and femoral shaft fracture. She underwent surgery, including open reduction and internal fixation (ORIF) with hardware implantation. She subsequently underwent inpatient rehab, home health care, and physical therapy. Collision-related medical bills were $186,982.52.

Although Malinski has not required active medical treatment in over a year, she continues to experience lingering discomfort and physical restrictions related to her injuries. Her future care is expected to include projected life care expenses and physical therapy.

Plaintiff’s attorney Jennifer L. Ashley recovered the underlying $25,000 liability policy and then pursued a UIM claim on Malinski’s behalf. The UIM claim proceeded to binding mediation before Hon. Judge Janet Adams Brosnahan, (Ret.) through ADR Systems on September 10, 2026. The claims were resolved in full for a total recovery of $1.25 million.
