Your lawsuit begins with filing a complaint in the appropriate court and serving a copy of it on the negligent party, or “defendant.” This complaint sets out the legal claims that you, the “plaintiff,” have against the defendant and what compensation or legal relief you are requesting. The defendant has an opportunity to respond to your lawsuit and set out any counterclaims he or she may have against you.

Once this step is complete, the parties engage in the process of discovery. This involves the locating and exchanging of information and evidence each party intends to use to support its claims.

Depositions of witnesses may be taken, and evidence may be analyzed by one or more expert witnesses. For example, your medical notes and records may be reviewed by another doctor as part of discovery.

Once discovery is completed, the parties may file one or more motions with the court seeking to resolve the case before trial and/or asking the court to establish certain rules and guidelines for the trial. In the event your matter does not settle before trial, it will then be held before a judge or jury, which will render a verdict in favor of one party of the other. The losing party may be able to appeal the verdict to an appellate court.

Deciding which court in which to file your lawsuit is a decision you and your Illinois personal injury attorney will decide after reviewing the facts of your case and the parties involved.

In most situations, your case will be filed in the Circuit Court with jurisdiction in the area where your accident occurred.
